White House readies antitrust case against Netflix, WBD deal

White House readies antitrust case against Netflix, WBD deal

Netflix wants to purchase WBD’s studio and streaming assets, but the White House would clearly rather see those assets go elsewhere.

Known for breaking major streaming stories, he’s covered everything from Netflix policy shifts to Peacock’s ad-tier changes. A sci-fi fan and Toshiba Fire TV user, he brings sharp analysis and a love for the genre to his reporting.

Warner Bros. Discovery CEO David Zaslav has the bidding war he wanted. Zas has drummed up quite a bit of interest in the assets currently owned by WBD, and more than one company has submitted an offer for their desired portion of the firm. Netflix has thrown its hat in the ring to acquire part of WBD, but a new report indicates the kind of trouble shaping up for the streamer in terms of regulatory headwinds.

Key Details:

  • From the top: White House officials have reportedly met to discuss antitrust concerns arising from Netflix’s pursuit of WBD.
  • Not the favorite: Throughout the process, the Trump administration has favored an acquisition of WBD by Paramount.
  • Far from the norm: Such direct interference in similar media transactions by the White House is quite rare.

An exclusive report from the New York Post indicates that Netflix’s pursuit of WBD assets is generating discussions at the White House about possible antitrust concerns. White House officials met in recent days to discuss the streaming marketplace power of Netflix if it were to successfully acquire WBD’s assets.

“Basically everyone agreed that Netflix presents unique antitrust concerns and if it won the bidding war it would be one long slog and touch off an investigation along the lines of those of Google and Amazon,” a government official told The Post.

There is no doubt that if Netflix were to acquire WBD’s movie studio and streaming assets, it would control an imposing library of intellectual property, including DC Studios, Harry Potter, The Lord of the Rings, Game of Thrones, and other major franchises currently owned by WBD, on top of its own original content. Such an acquisition could indeed make it difficult for companies smaller than Disney to compete with Netflix in the streaming marketplace.

It must also be pointed out that the Department of Justice is the governmental organization that will ultimately determine whether or not Netflix’s acquisition of WBD’s streaming and studio assets presents antitrust concerns large enough to axe any deal, not the White House.

Netflix is, of course, not the only outlet in pursuit of WBD. Paramount and Comcast have also bid on WBD assets; Comcast wants the streaming and studio portions of the company as Netflix does, while Paramount wants to take over the entirety of WBD — including its cable channels. Paramount CEO David Ellison’s father, billionaire Larry Ellison, is a major Trump supporter, and the administration is widely expected to favor Paramount’s pursuit of WBD as a result.

President Trump has personal animosity toward Comcast CEO Brian Roberts, and Netflix co-founder Reed Hastings supported former vice president Kamala Harris in the 2024 presidential campaign, which could well earn it the ire of the White House. For those reasons, analysts expect both Netflix and Comcast to run up against potentially insurmountable difficulties in their pursuits of WBD. It’s highly unusual for any administration — Democratic or Republican — to so publicly attempt to advance its own interest in major media deals, but the Trump White House hasn’t been shy about pushing such boundaries in the past.

WBD is still mulling bids and has not yet announced which offer it prefers. But if it chooses Netflix, it appears the streaming service would face significant opposition from the federal government in the form of antitrust concerns.
